Service or execution on Sunday of any writ, process, order, or judgment is void and the person serving or executing, or causing it to be served or executed, is liable to the party aggrieved for damages.
An employer can not assist and employee in avoiding service.
48.031(1)(b) states that an employer shall permit the process server to make service on an employee in a private area designated by the employer. If the employer, employee, or a representative or agent of the employer fails to comply with paragraph, he or she commits a misdemeanor of the first degree, (f.s.s. 843.02)
You have 120 days from the filing of the initial pleading directed to that defendant to obtain service.
